Hearing Officer&nbsp;<strong>Denis J. McInerney<\/strong>&nbsp;concluded,<\/p>\n\n\n\n<p>\u201c<strong>Judge Joseph did not know about \u2014 much less authorize \u2014 the escape plan\u2026 However,<\/strong><\/p>\n\n\n\n<p><strong>I find that she inadvertently created the appearance of impropriety and bias.<\/strong>\u201d<\/p>\n\n\n\n<p>Joseph had allowed the defendant,&nbsp;<strong>Medina-Perez<\/strong>, to return to the courthouse lock-up,<\/p>\n\n\n\n<p>assuming he needed to speak privately with his lawyer.<\/p>\n\n\n\n<p>Unbeknownst to her, the attorney and a court officer later helped him exit through a rear door.<\/p>\n\n\n\n<p>McInerney dismissed claims that Joseph approved the escape but recommended<\/p>\n\n\n\n<p>a&nbsp;<strong>public reprimand<\/strong>&nbsp;for holding an off-the-record sidebar that fueled public mistrust.<\/p>\n\n\n\n<p>The&nbsp;<strong>Justice Department dropped federal charges<\/strong>&nbsp;in 2022 after Joseph reported herself and<\/p>\n\n\n\n<p>cooperated with the&nbsp;<strong>Massachusetts Commission on Judicial Conduct<\/strong>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Judge Cleared of Helping Immigrant Escape ICE Arrest A Massachusetts investigation found that&nbsp;Judge Shelley Richmond Joseph did not knowingly help an undocumented immigrant avoid&nbsp;ICE arrest, though she unintentionally contributed to the confusion.
