Judge Orders DHS to Remove Posts About Rep. McIver Case
Several Department of Homeland Security (DHS) posts about Rep. LaMonica McIver’s
alleged assault on federal officers have been deleted after a federal judge ruled they could unfairly influence her ongoing case.
McIver, a New Jersey Democrat, was charged in May
with assaulting ICE agents during a visit to the
Delaney Hall detention center in Newark.
She has pleaded not guilty and faces up to 17 years in prison if convicted.
Her legal team argued that DHS’s public comments — including posts calling the visit a
“political stunt” and saying lawmakers “put safety at risk” —
were “extrajudicial statements” meant to sway opinion.
Judge Jamel Semper ordered the government to remove them,
calling such remarks “prejudicial” and potentially harmful to a future jury pool.
Although most posts were deleted, one controlled by a journalist remains online.
McIver continues to seek dismissal of the charges.
